Swipe Credit Acceptable Use Policy

This Acceptable Use Policy ("Policy") outlines the rules and guidelines governing the use of Swipe Credit's services. By accessing or using Swipe Credit's services, you agree to comply with this Policy. If you do not agree with any part of this Policy, you may not use our services.
1. Prohibited Activities
You are prohibited from engaging in any of the following activities while using Swipe Credit's services:
a. Illegal Activities: You shall not use our services for any illegal or unauthorized purpose. This includes but is not limited to engaging in fraudulent activities, identity theft, money laundering, or any other activities that violate applicable laws and regulations.
b. Harmful Content: You shall not upload, transmit, or distribute any content that is harmful, offensive, defamatory, obscene, or otherwise objectionable. This includes content that promotes violence, discrimination, or hatred.
c. Intellectual Property Violations: You shall not use our services to infringe upon the intellectual property rights of others. This includes unauthorized use or distribution of copyrighted materials, trademarks, or any other proprietary information.
d. Unauthorized Access: You shall not attempt to gain unauthorized access to Swipe Credit's systems, networks, or accounts. This includes hacking, phishing, or any other form of unauthorized intrusion.
e. Data Breach: You shall not attempt to access, retrieve, or distribute personal data or sensitive information of others without proper authorization.
f. Malicious Software: You shall not upload or distribute viruses, malware, spyware, or any other malicious software that may harm or disrupt Swipe Credit's services or the devices of other users.
g. Spam and Unsolicited Communications: You shall not send unsolicited commercial communications, spam, or any other form of unwanted messages through our services.
2. Disclaimer of Warranties and Limitation of Liability
a. Services Provided "AS IS": Swipe Credit's services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Swipe Credit makes no warranty that its services will be uninterrupted, secure, or error-free.
b. No Monitoring Obligation: While Swipe Credit reserves the right to monitor its services for compliance with this Policy, Swipe Credit has no obligation to monitor, review, or investigate any content or activities on its platform. Swipe Credit shall not be liable for any content or activities that violate this Policy or any applicable laws.
c. No Liability for User Content: Swipe Credit shall not be liable for any content uploaded, transmitted, or distributed by users of its services. Users are solely responsible for all content they generate, share, or access through Swipe Credit's services. Swipe Credit disclaims all liability arising from user-generated content.
d. No Liability for Third-Party Actions: Swipe Credit shall not be liable for the actions, conduct, or content of third parties, including other users of our services. This includes but is not limited to any damages, losses, disputes, injuries, or harm arising from interactions with other users or third parties.
e. No Liability for Unauthorized Access or Security Breaches: Swipe Credit shall not be liable for any unauthorized access to or use of its servers, systems, or databases, or any personal or financial information stored therein. Swipe Credit shall not be liable for any security breaches, data losses, or compromises of user information, whether caused by third parties, users, or technical failures.
f. Maximum Liability Cap: To the fullest extent permitted by law, Swipe Credit's total aggregate liability to you for any and all claims arising out of or related to your use of Swipe Credit's services shall not exceed the amount you paid to Swipe Credit in the twelve (12) months preceding the event giving rise to liability, or one hundred dollars ($100), whichever is less.
g. Exclusion of Consequential Damages: In no event shall Swipe Credit be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of or inability to use Swipe Credit's services, even if Swipe Credit has been advised of the possibility of such damages.
h. No Liability for Service Interruptions: Swipe Credit shall not be liable for any interruptions, delays, failures, or unavailability of its services, whether caused by maintenance, technical issues, force majeure events, or any other reason.
i. Indemnification: You agree to indemnify, defend, and hold harmless Swipe Credit, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (i) your use of Swipe Credit's services; (ii) your violation of this Policy or any applicable laws; (iii) your violation of any rights of another party; or (iv) any content you submit, post, or transmit through Swipe Credit's services.
3. Compliance with Laws
You agree to comply with all applicable federal, state, local, and international laws and regulations while using Swipe Credit's services. It is solely your responsibility to ensure that your activities are legal in your jurisdiction. Swipe Credit makes no representations that its services are appropriate or legal for use in all locations.
4. Enforcement and Termination
a. Right to Suspend or Terminate: Swipe Credit reserves the right, in its sole discretion, to suspend or terminate your access to its services at any time, with or without notice, for any reason or no reason, including but not limited to violations of this Policy.
b. No Refunds: Swipe Credit shall not be obligated to provide refunds for any fees paid in connection with suspended or terminated accounts.
5. Modification of Policy
Swipe Credit reserves the right to modify, amend, or update this Policy at any time, in its sole discretion, without prior notice. The "Effective Date" at the top of this Policy will reflect the date of the most recent modifications. Your continued use of Swipe Credit's services after any modifications constitutes your acceptance of the revised Policy. It is your responsibility to review this Policy periodically.
6. Governing Law and Jurisdiction
This Policy shall be governed by and construed in accordance with the laws of Georgia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Georgia for the resolution of any disputes arising out of or related to this Policy or your use of Swipe Credit's services.
7. Severability
If any provision of this Policy is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect to the fullest extent permitted by law.
